Supreme Court Granted Bail to Vyapam Scam Whistle-blower

The Vyapam scam whistleblower Dr Anand Rai was granted bail by the Supreme Court on Friday. He was detained during an investigation into alleged protest violence.

Anand Rai was granted bail by a bench presided over by Chief Justice of India DY Chandrachud, who also ordered the trial court to set the requisite conditions for his release.

The Madhya Pradesh Professional Examination Board (MPPEB), which oversees administering many competitive tests in the state, is accused of manipulating digital data and OMR answer sheets in connection with the scam.

The charges against Vyapam officials in the fraud centre on their allegedly blackening the associated response circles in the OMR answer sheets after manipulating the related digital data of the OMR answer sheets (computer data) to improperly pass candidates in the MPPMT in 2012.

Anand Rai is accused of violating various provisions of the Indian Penal Code (IPC) and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act) and has been imprisoned for the past 60 days, according to senior attorneys Kapil Sibal and Vivek Tankha.

This was noted by the bench consisting of Chief Justice DY Chandrachud and Justice PS Narasimha. It also noted that the police had not yet submitted a chargesheet in the case and granted bail to Rai with the understanding that the trial court would impose limitations.

As a result of the filing of an FIR, Rai was taken into custody on November 15. His bail requests had been rejected by the trial court and the high court.

In his plea to the Supreme Court, Rai claimed that government officials’ “conspiracies” against him for discovering the scam led to his imprisonment. “The Applicant’s whole historical record is spotless and free of any disagreeable nature, except false implication in the cases brought as a result of political vendetta,” he stated. 

The petitioner claimed that the current situation was nothing more than another round of harassment and plots against him by officials who want to make life difficult for him at every turn.
