Our respected Supreme Court has taken some breakthrough decisions in the past year. It brings a ray of hope towards upholding our Democracy and Rights. Let’s take a look at some of the prominent statements of 2022
All women are entitled to safe and legal abortion, married or unmarried; Rape includes Marital Rape for the MTP act- Supreme court
The progressive decision of legally enabling women with their bodies, and their rights empowers women to decide for themselves.
Police and other law enforcement agencies should be sensitized towards the rights of sex workers – Supreme court
According to the law, any sex worker who experiences sexual assault should be given access to all services accessible to sexual assault survivors, including emergency medical help.
Two finger test on rape survivors are patriarchal and sexist; any person conducting the same will be prosecuted and penalised for misconduct – Supreme court
“The so-called test has no scientific basis. It re-victimises and re-traumatises the women. The two-finger test must not be conducted. The test is based on an incorrect assumption that a sexually active woman cannot be raped. Nothing can be further from the truth,” a bench of Justices D Y Chandrachud and Hima Kohli said.
The definition of the family should be expanded; it may take the form of domestic, unmarried partnerships or Queer relationships – Supreme court
It was stated that although these manifestations of love and families may not be typical, they are just as real as their conventional counterparts and that these non-typical displays of the family unit are just as deserving of legal protection as well as the benefits provided by social welfare legislation.
Education is not a business to earn a profit – Supreme Court
The Supreme Court has ruled in favour of regulating tuition costs charged by private universities, stating that fees set for professional courses must be reasonable and that education should not be provided for financial gain.
